Is anyone financially liable for the damages that result from illegal deforestation?
I spent a week with Jay Pendergrass (law) and Carol Jones (economist) of the Environmental Law Institute (ELI) exploring this question. ELI has long been at the forefront of environmental law and policy, and we are drawing on their expertise to help inform some of our projects in the tropics, specifically related to natural resource damage assessments and environmental liability. In particular, Carol and Jay have been involved in precedent-setting cases, including in the economic valuation of damages resulting from the Exon Valdez oil spill. We're exploring how/whether similar liability-based approaches can be applied to illegal deforestation in the tropics.
